Xgatormotorsports.com Terms of Sale

All transactions are governed under the laws of the State of Florida which apply to and
interpret your and Xgatormotorsports.com’s rights, duties, and obligations arising from
these transactions, as supplemented or modified by this Agreement, without regard to
conflict of law principles.
Xgatormotorsports.com will only accept your order only if (1) you accept the terms of this
Xgatormotorsports.com Acquisition Agreement (“Agreement”), (2) you provide a valid ship
to address within the United States, and (3) The Product or Service is available.
You accept the terms of this Agreement by clicking to accept these terms and completing
your transaction when ordering online or, when ordering by any other means, by opening the
package containing the Product.
Payment
We accept Visa Card, Mastercard, Discover Card. Payment must be received in full before
your order is shipped.
Order Cancellation Policy
After you place an order, you can cancel your order within 1 hour by phone or email without
any charge. If you want to cancel your order, please call us at 754-242-6004 or email your
cancellation request to xgatorpowersports@gmail.com during our normal business hours.
Xgatormotorsports.com usually starts to process your order on the same business day. Our
early order processing works include address verification, shipment document preparation,
charge your credit card (we will be charged by credit card company for transaction fee), and
notify the warehouse to pack your item. Therefore, if you want to cancel your order after 1
hour, you will be subject to a 6% order cancellation fee. Once your item has been sent to the
warehouse, your order cannot be canceled. If you choose to cancel your order or refuse
delivery after your order has been shipped, you will be responsible for “To And From
Shipping And Handling Charges” incurred in shipping your order and a 25% restocking fee.
Shipping Policy

  1. All orders are processed between 1-3 business days. During the holiday season,
    due to extremely high volume, it may take more time to process orders.
  2. If you place your order by credit card and your shipping address has been verified, it will
    be shipped between 2-5 business days. For wire transfer, Cashier Check or Money Order
    Payment orders, we will ship your order on the day the fund is cleared into our account. 3.
    If you place your order by credit card and your shipping address and billing address are
    different, we may ask you to fill out an authorization form and send it back to us. Your
    order may not be shipped until we receive your signed authorization.
  3. For merchandise over 100lbs/box, it will be shipped by a professional LTL
    trucking company. For merchandise less than 100lbs, it will be shipped by FedEx,
    UPS or USPS.

5.. The shipping you get when you place the order is just the minimum charge. Final
shipping is based on the destination zip code.

  1. You will be emailed a tracking number after your order has been shipped. You can go to
    the shipping company’s website to track your shipment activities. Deliveries are by curb-side
    drop-off only with no signature required. It is the sole responsibility of the customer to
    monitor tracking information and to contact the carrier directly if you have any questions or
    concerns about their delivery process.
  2. Xgatormotorsports.com will try our best to ship your order to your door. However, for
    some extremely large size motorcycles (Extra Large 250cc Utility ATVs, 400cc ATVs, Extra
    large 150cc Go Karts, Extra Large 250cc Go Karts, 800cc Go Karts, UTVs), trucking
    companies’ life gates are not big enough to unload those vehicles. You are responsible to
    have several
    people to help the truck driver unload the vehicle or provide us with an authorized
    business address with loading dock or pick up at the trucking company local
    terminal.
    Shipment Inspection / Shipping damage Policy
    It is vital that you inspect your shipment immediately upon arrival, and note ANY damages to
    shipment, including damage to the shipping container. If there is ANY damage to your
    shipment, you must note this on the Bill of Lading when you sign for your package(s). You
    must also report any damages to Xgatormotorsports.com by phone at (754) 242-6004 within
    2 days of receiving your shipment in order for us to file a claim for any damages. If you
    report damages during that time, Xgatormotorspors.com will file the claim for you and ship
    out your parts free of charge. If you do not report damages to Xgatormotorsports.com within
    2 days we will not be able to file a claim for you, and you may have to pay for any parts you
    need shipped to you and file the claim with your shipping company separately for
    reimbursement. Also, please do a complete box count and write on the BOL how many
    boxes you received before the driver leaves. If a package is refused without approval of
    Xgatormotorsports.com, the restocking fee will apply. If your vehicle sustained structural and
    frame damages beyond repair, please refuse delivery and contact us immediately so we can
    prepare to send you a replacement unit. If you receive your vehicle with minor damages,
    please accept the vehicle and take pictures of your vehicles and email to us. We will send
    replacement parts to you free of charge.
    Return Policy
    We value your complete satisfaction. If within 7 days of receiving your vehicle you decide
    you do not want your vehicle for any reason, give our customer service department a call
    and we may refund you your money or send you a replacement based on our return
    policy agreement.
    The following is our Return Policy Agreement:
    Obtain a Return Merchandise Authorization Number (RMA) from our Customer Service
    Department. Any vehicles returned without an RMA number will not be accepted. A copy of
    your original invoice must be included in a return shipment. Customers are responsible for
    returning the merchandise at their own expense. Freight collect and COD packages will not
    be accepted.
    Vehicle must be returned in its original packaging within 7 days in new and re-sellable

condition.
Customers are responsible for appropriately packaging any product as original they wish to
return, including parts, accessories, and bikes. For vehicle returns, it is crucial that the
customer ensures proper packaging, so the delivery company accepts the item for return. If
the customer fails to package the vehicle correctly and the delivery company refuses to
accept the return, we will be unable to issue a refund in such cases. Therefore, we kindly
advise our customers to carefully adhere to the packaging guidelines to facilitate a
successful return process and ensure a refund is processed accordingly. This return policy
does not apply to vehicles that have had alterations, abuse, negligence, and accidents or
have not received proper maintenance.
All packaging materials, instruction manuals and parts must be returned. Any missing parts
or damages will be deducted from your refund amount. We do not accept any return vehicle
that has any sustained damages.
If the vehicle has been used and fueled, a return will not be accepted. The return policy
will be voided. You may only return your vehicle for repairs.
If you have received your vehicle for more than 7 days and have used it, you will not be
eligible to return it for refund or replacement. You can send the vehicle or parts to us at your
own expense; we will repair it and send it back to you at our cost.
In order to keep you completely satisfied and maintain rock bottom prices, our shipping
expenses are neither refundable nor reimbursed for any reason. This includes all freight
charges: the first shipment and return. Original freight expense will be deducted from your
refund.
Due to health and personal hygiene concerns, all clothing and helmets are non-refundable.
Order may be canceled only if we are unable to fulfill and ship your order within 5 business
days. You may also cancel your order if your item has not been shipped. However you will
be charged a 6% cancellation fee.
Warranty Policy
Our warranty is provided by the manufacturer of all featured products (Dirt Bike, ATV, Go
Kart, Moped, Motorcycles, etc.) and is provided to you through us the dealer. All
manufacturers warrant their vehicles for 3 months on the Engine parts only from the date
you receive your vehicle. We will service your vehicle under warranty at no additional costs.
Buyers are responsible to ship or tow in your vehicle to our facility for any warranty
service(s). Any outside repair labor charges, down time, towing or shipping charges are not
covered under warranty.
The following are warranty limitations and exclusions:
Wheels (tires and rim)
Clutches
Lubricants
Gaskets
Extreme riding, racing or competition
Loss of time without motorcycle
Vandalism, fire or theft
Crash or accident
Unauthorized outside repair
Warranty does not cover or reimburse any outside labor charges
Warranty does not cover any towing or shipping charges to and from

Standard wear and tear parts including but not limited to:
-Batteries
-Body Parts (fenders, covers, housings, etc.)
-Brakes
-Spark Plugs
-Throttle grips
-Hoses
-Fuel lines, brake lines
-Filters
-Brake & clutch levers
-Light bulbs
-Seats & upholstery
Defective warranty part(s) are required to be returned to exchange for new replacement
part(s). New replacement part(s) under warranty will be shipped to the buyer at no
additional costs. Returning your defective part(s) will ensure we send you the correct part(s)
and assist us in monitoring and correcting potential manufacturing defects.
Limitation of liability
In no event shall Xgatormotorsports or its suppliers be liable for lost profits or any special,
incidental or consequential damages arising out of or in connection with our site or items
purchased on or through our site or this agreement (however arising, including
negligence). Our liability, and the liability of our suppliers, to you or any third parties in any
circumstance is limited to the User’s cost of qualifying products purchased at the time of
entering into the agreement. Qualifying products as acceptable for return as outlined in the
return policy.
Price Information
Xgator Motorsports cannot confirm the price of an item until after your order is placed.
Pricing errors may occur on the Xgatormotorsports.com Sites or Xgator Motorspotrs stores.
Xgator Motorsports reserves the right to cancel any orders containing pricing errors, with no
further obligations to you, even after your receipt of an order confirmation or shipping notice
from Xgator Motorsports and we may, at its discretion, either contact you for instructions or
cancel your order and notify you of such cancellation. Pricing for products may be different
on the Xgatormotorsports.com Site or from prices available in Xgator Motorsports store or on
Xgator Motorsports mobile applications (pricing and availability remain subject to
confirmation at checkout for mobile users).
Purchasers Responsibility
You must inspect all equipment before using it and take full responsibility for assuring that
the equipment is in good working order and safe to use. You further understand that you are
responsible for damage to equipment. Purchaser understands the nature of motor scooter
riding and motorcycle related activities and acknowledges that Purchaser is qualified to
operate said motor scooter, and is in proper physical condition to participate in such activity.
Purchaser agrees to assume all risks when allowing others to operate Purchaser ‘ products
Inherent Risks
Warning! Riding activities of dirt bikes, scooters, ATVs, go karts, pocket bikes and UTVs
involve the risk and danger of serious bodily injury including, but not limited to, disability,

paralysis, dismemberment and death. These inherent risks and dangers may be caused by
Purchasers own actions or inactions, the actions or inactions of others, participating or not
participating in the activity, the condition in which the activity takes place, or the negligence
of others. There may be additional risks, including social and economic loss, either known
or
unknown to Purchaser, not readily foreseeable, and Purchaser fully accepts and assumes
responsibility for all such risks, losses, costs, and damages incurred as a result of
Purchaser’s participation in motorcycle riding activity.
Operation, Registration, and License
Purchaser is responsible for registering and operating the motorcycles in accordance with
local and state laws and ordinances. Seller makes no representations that the motor
scooters, dirt bikes, go karts, pocket bikes and ATVs are legal for operation in your City and
State. Customers have read and understood the use of these products before purchasing.
General
Any terms of this Agreement which by their nature extend beyond the Agreement termination
in effect until fulfilled, and apply to both of our respective successors and assignees. All legal
issues, should they arise, are to be filed in Deerfield Beach, Florida including but not limited
to: litigations and small claims court cases.
Xgatormotorsports.com will process, store and use information about your transaction and
your contact information, including name, phone numbers, and e-mail addresses, to
process and fulfill your transaction. Where permissible under local law, we may use this
information to inquire about your satisfaction with our Products and Services, if we do so,
you may at any time decline to receive any further communications from us.
